Dutch Gaming Authority Imposes €1.2 Million Fine on Techno Offshore for Regulatory Violations
The Kansspelautoriteit (KSA), the regulatory body overseeing gambling activities in the Netherlands, has levied a substantial fine of €1.2 million (£1 million/$1.3 million) against Techno Offshore, the operator responsible for the Nolimitbet.com and Simplecasino.com gaming platforms. This penalty highlights ongoing challenges regarding compliance in the online gambling sector.
The KSA’s ruling underscores that Techno Offshore was found to be offering gambling services to Dutch players without the necessary licensing. According to Dutch law, online gambling operators must secure regulatory approval before engaging in activities targeting residents of the Netherlands.
On April 9, the KSA elaborated on the charges against Techno Offshore, stating that the company failed to implement adequate measures to prevent Dutch players from accessing its platforms. The investigation revealed significant lapses, including the absence of age verification processes during registration and the inclusion of features deemed illegal, such as autoplay.
In April of the previous year, the KSA initiated its inquiry into Techno Offshore, discovering that the company operates from the British Virgin Islands and holds a gaming license from the Kahnawake Gaming Commission for the aforementioned brands. At that time, the KSA indicated that Simplecasino.com was actively providing both casino games and sports betting services in the Netherlands without a valid license, allowing players to register despite not meeting regulatory criteria.
A subsequent investigation in June 2024 continued to probe into Nolimitbet.com and Simplecasino.com, reaffirming that both platforms were functioning in the Netherlands unlawfully, with little to no action taken to deter Dutch users from participating.
Consequences Following KSA’s Warning
Prompted by these findings, the KSA issued a formal order for Techno Offshore to cease operations in the Netherlands or face escalating penalties. Further developments in November revealed that the operator faced an initial fine of €280,000 (£239,959/$310,218), which was subject to a potential increase.
In January, the KSA issued a comprehensive report outlining the justification for the financial penalty. Despite being offered a chance to respond, Techno Offshore reportedly did not engage with the regulatory authority. The KSA ultimately determined the penalty sum by evaluating multiple aggravating factors, resulting in an increased fine—reflecting the severity of their infractions, including the nature of the games offered and the incorporation of prohibited features.
KSA’s Commitment to Consumer Protection
Reflecting on this case, KSA board member Michel Groothuizen emphasized the regulator’s unwavering commitment to maintaining stringent oversight over illegal online gambling operations. He noted the discrepancies in player protection measures between licensed and unlicensed platforms, which pose significant risks to consumers.
"Licensed operators in the Netherlands are bound by stringent guidelines designed to shield players from harmful gambling behaviors," Groothuizen explained. “Contrarily, unregulated providers tend to neglect these essential safeguards. It is imperative that we take decisive action against those who lure players into these risky environments, where consumer safety is severely compromised.”
