SPA Leader Affirms Ban on Betting with Social Welfare in Brazil

Regis Dudena: A New Era for Gambling Regulations in Brazil

In a significant move for Brazil’s gambling landscape, Regis Dudena, the head of the Secretariat of Prizes and Bets (SPA), has announced a ban on gambling activities involving social welfare funds. This decision aims to protect vulnerable populations, including recipients of financial assistance programs like Bolsa Família and the Continuous Benefit Payment (BPC).

In a recent discussion with Estadão, Dudena detailed the SPA’s intention to prohibit individuals benefiting from these social welfare initiatives from engaging in betting activities. This policy aligns with a ruling by the Supreme Federal Court, which reinforced Minister Luis Fux’s emergency measure aimed at safeguarding social welfare recipients.

This initiative is set to be formally established in the coming months, pending a thorough legal review. Dudena explained, “We are finalizing our approach to ensure that our actions fully comply with the Supreme Court’s mandate.” The idea is to find a suitable mechanism that can enforce this new restriction effectively.

Challenges Ahead: Implementing the Ban

Despite the intent to introduce this ban, Dudena acknowledged potential difficulties in its implementation, particularly given that around 20 million Brazilians could be affected. Data from the Central Bank of Brazil indicates that a notable portion of funds from the Bolsa Família program has been diverted to online gambling platforms. Last August, reports showed that roughly 20% of the aid distributed was spent on betting.

Interestingly, the dynamics of how beneficiaries access their funds complicate matters. The National Secretariat of Citizen Income (Senarc) has noted that only 1% of Bolsa Família recipients utilize their cards for transactions. Most beneficiaries prefer accessing their funds through online bank accounts, which could also receive additional deposits. “The Supreme Court’s guidelines require us to enforce a restriction, and we are committed to implementing it in the most effective manner,” Dudena stated.

One proposed solution is to prevent these welfare recipients from using their Individual Taxpayer Registration (CPF) numbers for betting. Dudena indicated that this approach would be more effective than attempting to block transactions through the Bolsa Família card itself, given that the majority of payments are deposited in accounts rather than loaded onto standalone cards.

Enhancing Transparency in Brazil’s Betting Scene

In a parallel effort to bolster oversight within the gambling industry, the SPA plans to release quarterly performance reports on the betting sector. These reports will provide transparency and accountability, sharing crucial metrics such as the number of registered bettors, total wagers, and financial outcomes for operators.

Dudena elaborated, “Our goal is to create a comprehensive report that informs the public about the state of betting in Brazil.” The SPA is implementing its Betting Management System (Sigap), which will facilitate daily updates from operators about their activities.

As the SPA prepares to unveil its strategic agenda for the next two years, highlighted discussions around illegal gambling operations persist. Andre Gelfi, CEO of the Brazilian Institute of Responsible Gaming (IBJR), recently pointed out that illicit markets still capture approximately 60% of Brazil’s monthly gross gaming revenue.

Dudena believes that the SPA is in a cyclical process of evaluation and enhancement of its regulations. He remains optimistic about the efficacy of these measures, particularly in protecting underage individuals from gambling activities. “In our regulated environment, we are achieving remarkable accuracy in safeguarding children and adolescents from exposure to betting, reaching nearly 100% compliance,” he remarked.

With these new regulations and reporting mechanisms in place, Brazil is taking pivotal steps towards assuring responsible gambling practices while supporting its most vulnerable citizens.
